Disputes regarding residential letting.

If you are in dispute regarding your residential lettting our specialist housing team may be able to help.  We have extensive experience in all matters of housing law, both under the old Assured Tenancy regime and the new Private Residential Tenancies.

We have lodged many applications with the First-Tier Tribunal (Housing & Property Chamber) and have attended numerous Hearings since its inception on 1st December 2017.  Our experience includes:

• Eviction of tenants
• Access rights
• Recovery of unpaid rent
• Recovery for damage 
• Removal of unauthorised occupants


Our Firm’s fees for the provision of Housing Law Services relating to the eviction of tenants and recovery for property damage & unpaid rent shall be no more than the amounts set out in the tables below.  The fees noted below do not include outlays and VAT.
 

Table 1 - Ending Tenancy and Eviction.

  • Reviewing lease documentation & arrears statement.
  • Identifying the appropriate course of action and making recommendations to you;
  • Drafting appropriate Notice(s) to Leave (for Private Residential Tenancies) or Notice(s) to Quit and Form AT6 (for Short Assured Tenancies);
  • Serving Notices upon tenant(s);  and
  • Checking with you to determine whether tenant(s) have vacated.

Stage 1a

  • If required, drafting and issuing appropriate Pre-Action Requirement Information (actions based on rental arrears).

Stage 1b

  • If required, instruction of Sheriff Officers to effect service of the Notice(s) upon the tenant(s) and reporting to you.

Stage 2

  • Obtaining your instruction with regard to raising an Application to the First-Tier Tribunal (Housing & Property Chamber);
  • Drafting and Issuing S11 Notice;
  • Drafting the Form E Application;
  • Collating the required evidential documents;
  • Lodging the Application with the First-Tier Tribunal (Housing & Property Chamber);
  • Corresponding with the First-Tier Tribunal where appropriate; and
  • Noting the date and location of the Case Management Discussion and updating you.

Stage 2a 

  • If required, we will draft a second Application for an Order for Payment and lodge that along with the Application for Eviction.

Stage 3

  • Preparing submissions;
  • Travelling to first Case Management Discussion (within 5 mile radius of Aberdeen City Centre);
  • Waiting for case to call; and
  • Attend first Case Management Discussion on your behalf and represent your interests (up to 1 hour of advocacy).

Stage 4

  • Obtaining the Order from the First-Tier Tribunal (Housing & Property Chamber), reviewing and providing you with copy of same;
  • Discussing enforcement options with you and obtaining your instruction;
  • Instructing Sheriff Officers accordingly; and
  • Obtaining Sheriff Officers’ report and updating you.

Non-Standard
Any work that falls out with the stages noted above will be charged as agreed with you  following further discussion (exclusive of outlays and VAT).
This will include:
• Consideration of any Response Form and advising you;
• Preparation for and attendance at any subsequent Case Management Discussion; and
• Preparation for and attendance at any Evidential Hearing.
 

 

Table 2  – Recovery for Property Damage & Unpaid Rent

  • If required, instruction of a Tracing Agent to locate tenants' current whereabouts and determine employment status and reporting to you.

  • Obtaining your instruction with regard to raising an Application to the First-Tier Tribunal (Housing and Property Chamber);
  • Drafting the Form F Application;
  • Collating the required evidential documents;
  • Lodging the Application with the First -Tier Tribunal (Housing & Property Chamber);
  • Corresponding with the First-Tier Tribunal  where appropriate; and
  • Noting the date and location of the Case Management Discussion and updating you.

£250

Stages 3, 4 and Non standard.

  • As per table 1 above.
