Power of Attorney: Why Planning Ahead Matters More Than You Think
It’s never too early to arrange your Power of Attorney, but it can be too late.
It’s easy to think of Power of Attorney as something that you can comfortably put off to a later date, because it is only something that is likely to affect you in older age.
However incapacity can affect any one of us at any time – not just as a result of illnesses which tend to be associated with older age, such as dementia and Alzheimer’s, but as a result of a sudden trauma such as a stroke, serious accident or head injury.
If you suffer a sudden loss of capacity and you don’t have a Power of Attorney in place, the consequences for you and your family can be catastrophic and costly. If there is no Power of Attorney in place, a family member can apply to the Sheriff Court to be appointed legal guardian, but this is a slow and very expensive process which its best to avoid.
The simple solution for everyone is to arrange a Power of Attorney while you can, and hope that it will never be needed.
